Workers Comp
Work Related Injury or Illness Process
These steps are to ensure our Team Members receive the appropriate care for their injuries or illness.
STEP 1: Determine the extent of the injury and arrange for medical care:
Emergency: call 911 immediately.
Hospitalized: determine if notification to Cal OSHA is required. Emergency injuries and illnesses include but are not limited to:
Excessive bleeding and broken bones
Chest pain
Unconsciousness
Life-threatening injuries
Minor injury/First Aid: Minor injuries may be treated with items provided in the first aid kit. Those might not need to be reported as Workers' Comp claim.
Send the Team Member to the nearest clinic if the injury is minor but requires medical attention. The doctor will determine whether or not the injury qualifies as “First Aid” and will be shown on the Work Status Report. If drugs are prescribed, it is not a First Aid claim. First Aid claims are a one-time treatment and follow-up visit for observation. First Aid injuries include by are not limited to:
Minor cuts, scratches, scrapes, contusions
Minor burns
ACTION REQUIRED: For any minor injury or Fisrt Aid accident, the INCIDENT REPORT must be completed and saved under Team Member File. HR can also send this via Adobe Sign.
NOTE:
Team Members can go to the clinic during working hours. Those hours should be paid at Team Members regular rate of pay. They can stay clocked in.
Sick time can be used if the Team Member needs to recover or rest.
STEP 2: Sending the Team Member to the Clinic and the Responsibilities of the Supervisor:
Notify HR immediately after the incident.
Supervisors MUST complete the SUPERVISOR REPORT
Team Members MUST complete the INCIDENT REPORT
Optional: WITNESS Report
If possible, ask the Team Member to return to work immediately after visiting the clinic. Team Members must provide a copy of the Work Status Report they received at the clinic. This report will tell if the Team Member can work full duty if they have limitations that can be accommodated through modified duty.
STEP 3: HR will Provide documents to the Insurance Carrier:
Worker’s Compensation Form- DWC-1
Form 5020
Work Status Report
Job Description
Complete Cal/OSHA form Log 300
SAVE ALL DOCUMENTS, PHOTOS, AND FORMS RELATED TO THE ACCIDENT IN ONE FOLDER.
STEP 4: Corrective actions:
Supervisors must analyze the accident and make adjustments to prevent a similar accident or injury from reoccurring.
